Pennsylvania can very well be the Florida of 2020. If Pennsylvania election officials reject the Trump petition, we can quickly get an education in the Constitution of the United States.
Even if Chief Justice Roberts lines up with the socialist wing, it’s not that much of a stretch to see the 5 conservative/libertarian justices taking a “textualist” view.
Textualist in this context means to give primary weight to the text and structure of the Constitution as it would have been understood to mean by an ordinary person at the time it was written.
The plain language of Section 1 reads as follows: “Each State shall appoint, in such Manner as the Legislature thereof may direct, a Number of Electors, equal to the whole Number of Senators and Representatives to which the State may be entitled in the Congress: but no Senator or Representative, or Person holding an Office of Trust or Profit under the United States, shall be appointed an Elector.”
Simply put, both houses of the legislature of the Commonwealth of Pennsylvania are Republican.
And guess who gets to write the majority opinion in the event Chief Justice Roberts switch-hits with the socialists.
